Beta Program Agreement

Please read carefully. This Beta Program Agreement ("Beta Agreement") supplements — and is incorporated into — the Pishik Terms of Service and Privacy Policy. You agree to this Beta Agreement, in addition to the Terms, by creating a workspace (the sign-up screen states that by joining you agree to this Beta Agreement), by activating an account through a teammate invitation (the invitation page states the same), or by otherwise accessing or using the Service during the beta. If you do not agree, do not participate in the beta.

1. What the beta is

Pishik is offered on an invite-only, pre-release ("beta") basis. The Service is under active development. Features may be incomplete, may change substantially, may not operate as described, may contain errors or defects, and may be added, modified, suspended, or removed at any time, without notice. The beta is made available so that we can develop and improve the Service — not as a finished commercial product.

2. Acknowledgment of risks

You acknowledge and accept that participation in the beta carries inherent risks, including without limitation: (a) interruptions, downtime, and outages, scheduled or not; (b) bugs, errors, and unexpected behavior, including workflows that stall, emails that are not delivered, or statuses that display incorrectly; (c) loss, corruption, or unavailability of data entered into the Service; (d) changes that remove or alter features you rely on; and (e) the possibility that the beta — or the Service as a whole — is discontinued entirely. You are responsible for maintaining your own backups (the Service includes an export feature) and for not relying on the beta as your sole system of record for any critical matter.

3. No warranty; no service levels

WITHOUT LIMITING THE DISCLAIMERS IN THE TERMS OF SERVICE, THE BETA IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE PROVIDE NO SERVICE-LEVEL COMMITMENTS, NO UPTIME GUARANTEE, AND NO SUPPORT OBLIGATIONS DURING THE BETA. ALL LIMITATIONS OF LIABILITY IN THE TERMS OF SERVICE APPLY FULLY TO THE BETA.

In practice, we do answer questions and help beta participants on a best-effort basis through our Support Center — this section means only that we are not contractually obligated to provide support or to meet any service level or response time during the beta.

4. Feedback is Pishik's property

A core purpose of the beta is gathering feedback. "Feedback" means any suggestions, ideas, feature requests, bug reports, comments, improvements, test results, survey responses, or other input you (or your Users) provide about the Service, in any form. You agree that all Feedback is and becomes the sole and exclusive property of Pishik. To the maximum extent permitted by law, you hereby irrevocably assign to Pishik all right, title, and interest in and to all Feedback, and to the extent such assignment is not effective, you grant Pishik a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable and transferable license to use, reproduce, modify, distribute, display, and otherwise exploit the Feedback for any purpose, without attribution, compensation, or obligation to you. You represent that your Feedback does not include information you are obligated to keep confidential.

5. Invite codes & access

Beta access is granted by single-use invite codes issued at our sole discretion. Codes are personal to the recipient, may not be sold, published, or transferred without our permission, and may be revoked at any time. We may limit, suspend, or terminate beta access — for any participant, at any time, for any reason or no reason, with or without notice. We may also decline to migrate beta workspaces or data to any future release.

6. Pre-release confidentiality

The beta may include non-public features and information. Unless we have made a feature publicly available or given written permission, you agree not to publicly disclose non-public features of the Service, benchmark results, or screenshots of unreleased functionality. General descriptions of Pishik and your experience with publicly visible features are fine.

7. Fees; transition to paid plans

The beta is provided free of charge. As set out in the Terms, pricing is subject to change at any time, beta access is not a promise of perpetual free service, and we may introduce paid plans at or after the end of the beta.

How the transition works. When Pishik launches commercially, each beta workspace will receive a decision window of at least thirty (30) days, announced by in-app notice and by email to the workspace's administrators. During that window the workspace may select any then-current paid plan — including, as our thank-you to beta participants, a beta-exclusive Founding rate that preserves the workspace's existing seat count at a preferential flat monthly price. The Founding rate is offered only during the decision window and only to workspaces that participated in the beta; published tier pricing, and the Founding rate itself, may be adjusted before launch, and the prices in effect when the window opens are the ones offered.

If no plan is selected. If a workspace has not selected a plan by the end of its decision window, access to the workspace is suspended — not deleted. Suspension blocks sign-in but preserves all workspace data intact; selecting a plan (or contacting us) restores access. Workspace data remains available for export for at least sixty (60) days following suspension before any deletion under Section 8 is considered, and we will not delete a suspended workspace's data without reasonable prior notice to its administrators.

8. End of the beta

We may end the beta (in whole or part) at any time, with or without launching a commercial version. At the end of the beta we may require you to accept updated terms, select a paid plan under the transition process described in Section 7, or export your data; we may delete beta data only after the export window described in Section 7 and reasonable prior notice. Sections 3, 4, and 6 of this Beta Agreement survive its termination.

9. Order of precedence

This Beta Agreement supplements the Terms of Service. If this Beta Agreement conflicts with the Terms with respect to the beta program, this Beta Agreement controls; otherwise the Terms control. Capitalized terms not defined here have the meanings given in the Terms.
